Terms and Conditions

These Terms and Conditions (“Agreement”) govern the relationship between the Tourist(s), and us, Zamorine India Hospitality LLP (herein after, “Company”). By booking/ initiating a trip, tourist(s) agree to be bound by these Terms and Conditions. These terms affect tourist(s) rights to sue, governing law, social forum, and jurisdiction. The tourist(s) is expected to understand these terms carefully and agree the rights and obligations before initiating any transactions. (In the event, there is a representative/ employee would be a reference and shall represent to the “Company” severally).

For the services contracted, minimum 50% advance payment should be made to hold the booking on a confirmed basis and the balance amount should be paid before commencement of the tour. The company hold the right to decide upon the amount to be paid as an advance payment, based on the nature of services and the time left for the commencement of the services. Apart from the above, in some cases like special bookings during the festive or high peak tourist season, a full payment is required to be sent in advance. Once booking is completed, the tourist(s) will receive the respective Hotel vouchers (This takes 1-2 weeks depends on urgency as the company need to get an email confirmation from the hotels before sending out any voucher). All necessary details will be proactively communicated through SMS/ Messenger /email on prior to the arrival.

Payment can be made by Credit /Debit Card/ UPI/ Paytm/ PayU, Internet banking. etc through the Company’s secured online payment gateway system, by Bank Transfer, Cash payment to the offices/representative in the destination city is also an option. All payments should be free and clear of any withholding tax and deduction. Bank charges, if any, for remittance (by remitting bank or by intermediary bank) would be strictly borne by payer, such as additional 2.5% card charges.

Tour once commenced will strictly go as per the itinerary finalized. In case of events and circumstances beyond control, The Company reserve the right to change all or parts of the contents of the itinerary for safety and well being of our esteemed Tourists. Willful amend request may cost depends on the cancellation policy and will be giving other options with cost difference. There will not be any additional amendment charges from the company.

 

In case of cancellation of tour/travel services due to any avoidable/unavoidable reason/s, the company must be informed in writing. Cancellation charges would be effective from the date, were the company receives letter in writing and charges would be as follows:

Above 60 days prior to arrival – 20% of the tour/service cost.
59 days to 30 days prior to arrival – 40% of the tour/service cost.
29 days to 9 days prior to arrival – 60% of the tour/service cost.
8 days & less, prior to arrival or no show – No Refund

Important Note – Irrespective of above mentioned cancellations slabs – in case of cancellation of tour services after the booking is made – all refund issues shall be under the sole discretion of the company as some properties have the nonrefundable policy and high peak season bookings (Special seasons like Diwali – 15th Oct to 15th Nov – & X’ Mas / New Year period – 15th Dec to 15th Jan) No refund will be provided irrespective of the slabs. In case the tourist(s) cancel the trip after commencement refund would be restricted to a limited amount that too would depend on the amount that The Company would be able to recover from the hoteliers patronize. For unused hotel accommodation, chartered transportation and missed meals etc., company does not bear any responsibility to refund.

In regard to refund of unused / unutilized services (which are paid for and cancelled in advance) the refund amount would be worked out on the basis of cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to the company. Refund process may take 2 – 3 weeks due to recollecting/ banking procedures. If the refund is made to the credit card account OR to Bank account, the bank charges would be debited from the refund amount. All refund resolution shall be under the sole discretion of the company.

The responsibility of the Company and its affiliated companies is strictly limited. As a tour operator, Company organizes, promotes, and sells tour programs consisting of certain travel services, including surface, air, and water transportation, Activity, sightseeing excursions, and cruise/barge/hotel accommodations that company purchases or reserves from various suppliers (collectively, “Suppliers”). Company does not own or operate any of these Suppliers. The Suppliers providing travel services for company ‘s programs are independent contractors and are not agents or employees of the company. As such, company is not responsible for any negligent or willful act or failure to act of any Supplier or of any third party. Some tours include visits to shops and merchants. Company is not responsible for any purchases you make during your trip, whether that merchant is part of the scheduled itinerary or not. By utilizing the travel services of the Suppliers, you agree that you will look to such Suppliers for any accident, injury, property damage, or personal loss to you or to those traveling with you, and that neither company nor any representative of the company shall be liable. Company accepts and assumes responsibility for its own negligent or reckless conduct. You accept and assume responsibility for your own negligent or reckless conduct while participating in the tour program and the loss associated. Company reserves the right to decline to accept or retain any person as a member of any tour or to cancel or alter the tour without notice. After the finalization of the tour/service cost, if there are any hikes in entrance fees of monuments/museums, taxes, fuel cost or guide charges by the Govt. of India, the same would be charged as extra. The Company act only in the capacity of a facilitator/agent for the hotels, airlines, transporters, railways & contractors providing other services & all exchange orders, receipts, contracts & tickets issued are issued subject to terms & conditions under which these services are provided by suppliers. All itineraries are sample itineraries, intended to give you a general idea of the likely trip schedule. Numerous factors may dictate itinerary changes either before the tour or while on the trail and the Company reserve the right to change such schedules in the interest of the trip participants’ code of conduct, safety, comfort general well-being & trip objectives. Service charges are based on the prevailing rates as negotiated by company with the suppliers and they retain the right to modify the rates without notice. In case of such changes the rates quoted before the modification, can be changed by the company according to the modifications. All hotel/ houseboat bookings are based on usual check in and checkout time until unless indicated in the itinerary. Company shall not be responsible for any delays & alterations in the program or expenses incurred – directly or indirectly – due to natural hazards, flight cancellations, accident, breakdown of machinery or equipment’s, breakdown of transport, weather, sickness, landslides, political closures or any untoward incidents. The company shall not be responsible for any loss, injury or damage to person, property, or otherwise in connection with any accommodation, transportation or other services, resulting – directly or indirectly – from any act of nature, dangers, fire, accident, breakdown in machinery or equipment, breakdown of transport, wars, civil disturbances, strikes, riots, thefts, pilferages, epidemics, medical or custom department regulations, defaults, or any other causes beyond our control. Company do not hold any insurance policy covering the expenses for accident, sickness, loss due to theft, or any other reasons. Visitors are advised to seek such insurance arrangements in their home country. All baggage & personal property/s at all times are at the traveler’s risk.

Booking Flights and Processing of Visa is not included in the tour package cost. The tourist(s) are expected to manage the same on self-accountability. Major information’s on passport including name, passport number and expiration date may have needed at time of booking. If the destination requires a visa, tourist(s) are responsible for obtaining a visa prior to arrival. Tourist’s should contact the appropriate consular office for any requirements pertaining to the trip. Company is not responsible in any way for such failure and damages.

Tourists are expected to advise the company in writing, at or prior to booking, of any physical, emotional or mental condition which may require professional attention during the trip or may require the use of special equipment’s. If the tourist fails to disclose any such conditions, The Company may refuse to allow the tourist(s) to take the trip and you will forfeit the trip cost; and in such event, Company shall have no liability, financial or otherwise. If the tourist(s) are so challenged, they must bring and be responsible for all necessary items related to their condition. If any such condition arises after the trip is booked, tourist(s) must advise in writing immediately. Failure to advise shall release the company and all professional personnel from any liability related to such condition or its treatment. The company cannot accommodate women past their sixth month of pregnancy. Any person who has a contagious disease is forbidden to travel, any person found during the tour with such a disease will be asked to leave the tour and will have to make their own arrangements to return home.

Overnight Houseboat (if provided with itinerary) is 12.00 noon check in and 09.00 hrs. next day check out. Early arrival is subject to availability. For guaranteed early check-in, reservation needs to be made starting from the previous night. Later check-outs are available on request and subject to availability / Payment. The company can always make a request for early check-in or late checkout if required but the company do not guarantee that and its entirely depend upon the policy of the hotel, houseboat, time of the year and availability of the accommodation.

All notices given under this Agreement (including Cancellations, amendments and Grievances) must be in writing. A notice is effective upon receipt and shall be delivered by email or sent by registered mail only.

Tourist(s) agrees to comply with all applicable laws, ordinances, requirements and regulations of any federal, state, county, municipal or other authority. The Company is not responsible or liable for any of the actions, behaviors, damages caused by the Tourist(s).

All relationship shall be governed by the federal law of India/ laws of the State of Kerala. Any Grievances, legal procedures must be brought in the Courts located in Chalakudy, the State of Kerala without regards to its conflicts of law’s provisions and authorities to intervene. Consumer disputes must be brought in Kerala State Consumer Disputes Redressal Commission, Thrissur District. Any dispute arising from this Agreement shall be resolved through Mediation or Court litigation.

By initiating any process of service allied engagement from the Company or its suppliers, it is considered as the tourist(s) had approved the Terms & conditions agreement and ought to obey/ follow the guidelines without compromise. Willful amendment of this agreement may cost the tourist(s) and hereby the Company have every rights for the compensation(s).

This Agreement is inevitably executed chiefly with every engagement of the Company with its counterparts, online published version shall be deemed to be an original, and all of which together shall constitute one and the same document. This Agreement may not be amended or modified without a written consent from the Company.

If any provision of this Agreement is held to be invalid, illegal or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid, legal and enforceable as though the invalid, illegal or unenforceable part had not been included in this Agreement.

This Agreement constitutes the entire agreement between the Parties and supersedes and cancels all prior agreements of the Parties, whether written or oral, with respect to the subject matter.

WHEREOF, the Parties hereto, individually or by their duly authorized representatives, have executed this Agreement as of the Effective Date of engagement. This is an electronic document and no signature is required.
